Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you (the "Client," "you," or "your") and BusGrow ("BusGrow," "we," "us," or "our") governing your access to and use of our website, services, and any deliverables. By using our website, submitting a form, engaging our services, or paying an invoice, you agree to these Terms and to our Privacy Policy, SMS Terms, and Refund & Cancellation Policy.

1. About BusGrow

BusGrow is a small, hands-on business support service in the United States. We provide one-on-one, human-delivered services to local service businesses — including outreach calling, follow-up, appointment setting, customer communication, proposal management, and related operational workflows. 2. Services

Each engagement is scoped one-on-one after an intake conversation and documented in a written proposal or statement of work ("SOW"). The SOW describes the specific services, deliverables (typically outreach activity, booked appointments, and a weekly activity spreadsheet), duration, and fees. In the event of a conflict between an SOW and these Terms, the SOW controls for that engagement.

3. Eligibility and Accounts

You must be at least 18 years old and authorized to enter into a contract on behalf of your business. You are responsible for maintaining the confidentiality of any account or portal credentials we issue and for all activity under them.

4. Fees, Payment, and Billing

• Pricing. Fees are quoted in U.S. dollars in your proposal or SOW. Common structures include monthly recurring service fees, one-time setup fees, and project fees.
• Payment processor. Payments are processed by Stripe, Inc. By paying, you also agree to Stripe's terms. BusGrow does not store your full card details.
• Authorization. You authorize BusGrow (through Stripe) to charge your selected payment method for all fees on the schedule stated in your SOW. Recurring subscription fees are billed automatically each billing cycle until canceled per Section 9.
• Taxes. Fees are exclusive of applicable sales, use, or similar taxes, which you are responsible for.
• Late payments. Invoices are due upon receipt unless otherwise stated. Past-due amounts may accrue interest at 1.5% per month (or the maximum allowed by law) and may result in suspension of services.
• Receipts. A receipt is emailed automatically by Stripe after each successful charge.

5. Delivery and Turnaround

Ongoing services (outreach, follow-up, appointment setting) typically begin within five (5) business days after payment and intake completion, and continue on a rolling weekly cadence. Weekly activity reports are delivered by the end of each service week. Project or setup deliverables are provided by the date stated in your SOW.

6. No Guarantee of Results

Any projections, case-study numbers, sample dashboards, or example outcomes shown on our website or in proposals are illustrative only. Actual results depend on your market, offer, list quality, availability, and other factors outside our control. BusGrow makes no guarantee of revenue, leads, appointments, closings, or return on investment.

7. Client Responsibilities and Acceptable Use

• Provide accurate business information, contact lists, scripts or approval on scripts, calendars, and any credentials needed to deliver the services.
• Comply with all laws applicable to your business, including the TCPA, TSR, CAN-SPAM, state Do-Not-Call regulations, real-estate licensing rules, and consumer-protection laws.
• Ensure you have the legal right (including prior express consent where required) to contact any leads or customers we call, text, or email on your behalf.
• Do not use our services to promote illegal activity, adult content, weapons, controlled substances, hate speech, harassment, or fraudulent, deceptive, or predatory practices. We may refuse or terminate any engagement that violates these restrictions or Stripe's restricted-business list.

8. Intellectual Property

We retain ownership of our proprietary methods, templates, scripts, and internal tooling. Upon full payment, you receive a non-exclusive, perpetual license to use the deliverables prepared for you (call reports, spreadsheets, proposal templates) for your business. You retain ownership of your data, brand assets, and customer lists.

9. Term, Cancellation, and Termination

Ongoing services are month-to-month unless a different term is stated in your SOW. Either party may cancel at any time by written notice to busgrow@gmail.com. Cancellations take effect at the end of the current billing cycle. See our Refund & Cancellation Policy for details. We may suspend or terminate services immediately for non-payment, breach, or unlawful use.

10. Confidentiality

Each party will protect the other's non-public information with the same care it uses for its own confidential information and will not disclose it except to personnel and sub-processors with a need to know, subject to comparable confidentiality obligations.

11. Disclaimers

Services and the website are provided "as is" and "as available." To the maximum extent permitted by law, BusGrow disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty of specific results.

12. Limitation of Liability

To the fullest extent permitted by law, BusGrow's total aggregate liability arising out of or relating to these Terms or the services will not exceed the fees you paid to BusGrow in the three (3) months immediately preceding the event giving rise to the claim. In no event will BusGrow be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or goodwill.

13. Indemnification

You will defend, indemnify, and hold BusGrow harmless from any third-party claim arising from (a) your business, products, or services; (b) content or contact lists you provide; or (c) your violation of these Terms or applicable law.

14. Chargebacks and Disputes

If you believe a charge is incorrect, contact us first at busgrow@gmail.com within thirty (30) days of the charge. Initiating a chargeback without first contacting us may result in suspension of services and recovery of chargeback fees.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. The exclusive venue for any dispute not subject to arbitration is the state or federal courts located in Delaware, and each party consents to personal jurisdiction there.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date and, where reasonable, communicated by email. Continued use of the services after changes take effect constitutes acceptance.
